1. Acceptance of the Terms

Welcome to GoTyps. By accessing or using our platform, you agree to be bound by these Terms of Service ("Terms"). If you do not accept these terms, please do not use our services.

These Terms constitute a legal agreement between you ("User", "you", "your") and GoTyps ("we", "our", "us").

2. Description of the Service

GoTyps is a micro-marketing platform that connects:

• Businesses (Professionals): E-commerce companies wishing to promote their products through marketing campaigns
• Creators: Content micro-creators (Instagram/Facebook/TikTok) (0-500 followers) able to share sponsored content

Our service allows businesses to create campaigns offering product discounts as rewards, while creators publish content on Instagram, Facebook or TikTok and earn rewards based on their actual engagement metrics.

3. Eligibility

To use GoTyps, you must:

• Be at least 18 years old (or the age of legal majority in your jurisdiction)
• Have a valid and active Instagram, Facebook or TikTok account
• Be at least 18 years old
• Reside in a geographic area where our services are available
• For creators: have between 0 and 500 followers on your social networks (micro-creators)

4. User Accounts

4.1 Account creation

You must create an account to access certain features. When registering, you must provide accurate, complete and up-to-date information.

4.2 Account security

You are responsible for:

• Maintaining the confidentiality of your login credentials
• All activities carried out under your account
• Notifying us immediately of any unauthorized use

4.3 Suspension and termination

We reserve the right to suspend or terminate your account at any time, without notice, if:

• You violate these Terms
• You provide false or misleading information
• You engage in fraudulent or illegal activities
• You use bots, fake accounts or artificially inflate your metrics

5. Rules of Conduct

You agree not to:

• Use the platform for illegal or unauthorized purposes
• Publish hateful, discriminatory, harassing or violent content
• Infringe the intellectual property rights of others
• Distribute spam, viruses or malicious code
• Impersonate another person or entity
• Collect data from other users without their consent
• Use unauthorized automation, bots or scripts
• Artificially manipulate engagement metrics (buying likes, followers, etc.)
• Circumvent the platform's security measures

6. Campaigns and Missions

6.1 For Businesses

• Campaigns must comply with all applicable laws on advertising and marketing
• The rewards offered must be clearly described (value, conditions for obtaining them)
• You are responsible for fulfilling the rewards promised to creators
• GoTyps charges a 10% commission on the value of the rewards
• Campaigns must not promote prohibited products (tobacco, weapons, adult content, etc.)

6.2 For Creators

• Posts must comply with the guidelines of Meta and/or TikTok, depending on the connected account used for the campaign
• You must clearly indicate the sponsored nature of the content (#sponso, #partenariat, #pub)
• Engagement metrics must be authentic and not manipulated
• You may only participate in campaigns for which you are eligible
• Receiving rewards depends on the validation of the metrics by the business

7. Meta Integration (Instagram & Facebook)

By connecting your Meta accounts (Instagram/Facebook) to GoTyps:
• You authorize GoTyps to access profile data, posts and engagement statistics
• We do not have access to your passwords
• We cannot publish, modify or delete content on your behalf
• You certify that you are the legitimate owner of the connected accounts
• You agree to comply with the Terms of Service of Meta (Instagram and Facebook)
• You may disconnect your social accounts at any time
• We use this data exclusively to verify eligibility and measure campaign performance

8. TikTok Integration

By connecting your TikTok account to GoTyps:
• You authorize GoTyps to access your display name, your profile photo, the list of your public videos and their engagement statistics (views, likes, comments, shares)
• We do not have access to your TikTok password
• We cannot publish, modify or delete content on your behalf — no publishing permission is requested from TikTok
• You certify that you are the legitimate owner of the connected TikTok account
• You agree to comply with the Terms of Service of TikTok for Developers as well as the TikTok Community Guidelines
• You may disconnect your TikTok account at any time from your settings
• We use this data exclusively to display your connected account, to let you select one of your videos when submitting a campaign, and to verify its eligibility for payment

9. Payments and Commission

9.1 GoTyps Commission

GoTyps charges a 10% commission on the value of the rewards distributed. This commission is included in the total cost paid by businesses.

9.2 Payment processing

Payments are processed securely by Stripe. We do not store your bank details.

9.3 Refunds

Refund policies are determined on a case-by-case basis. Contact us for any refund request.

10. Intellectual Property

10.1 GoTyps Platform

The platform, its source code, its design, its logos and its content are the exclusive property of GoTyps and are protected by intellectual property laws.

10.2 User Content

You retain all rights to the content you publish. However, by using GoTyps, you grant us a non-exclusive, worldwide, royalty-free and transferable license to:

• Display, store and run your content on our platform
• Use your content for promotional purposes (with your prior consent)

11. Privacy

Our processing of your personal data is governed by our Privacy Policy, available at /legal/privacy-policy. By using GoTyps, you accept our privacy policy.

12. Limitation of Liability

To the fullest extent permitted by applicable law:

• GoTyps is provided "as is" without warranty of any kind
• We do not guarantee that the service will be uninterrupted, secure or error-free
• We are not liable for indirect, incidental, special or consequential damages
• We do not control and are not responsible for interactions between businesses and creators
• We do not guarantee the success of marketing campaigns
• Our total liability is limited to the amount you have paid to GoTyps over the last 12 months

13. Indemnification

You agree to indemnify and hold harmless GoTyps, its officers, employees and partners against any claim, loss, damage or expense (including reasonable legal fees) arising from:

• Your use of the platform
• Your violation of these Terms
• Your violation of the rights of a third party
• Your content published on the platform

14. Changes to the Service

We reserve the right to:

• Modify, suspend or discontinue the service at any time
• Add or remove features
• Limit access to certain parts of the service

We will inform you of substantial changes by email or notification.

15. Changes to the Terms

We may change these Terms at any time. The updated version will be published on this page with a new "Last updated" date. Continued use of the service after a change constitutes your acceptance of the new Terms.

16. Termination

You may terminate your account at any time from your settings. We may terminate or suspend your account immediately in the event of a violation of these Terms. After termination:

• Your access to the service ends immediately
• Some data may be retained for legal reasons
• Ongoing campaigns will be handled according to the established terms

17. Governing Law and Jurisdiction

These Terms are governed by French law. Any dispute relating to these Terms will be subject to the exclusive jurisdiction of the courts of Châtillon, France, subject to the mandatory provisions applicable to consumers.

18. Miscellaneous Provisions

18.1 Assignment

You may not assign your rights or obligations arising under these Terms. GoTyps may assign its rights without your consent.

18.2 No waiver

The failure of GoTyps to invoke a provision of these Terms does not constitute a waiver of that provision.

18.3 Severability

If a provision of these Terms is held invalid, the other provisions remain in force.

18.4 Entire agreement

These Terms constitute the entire agreement between you and GoTyps regarding the use of the service.
